According to Hans Kelsen, the basic norm is the necessary presupposition of the positivistic cognition of law, making possible both descriptive legal cognition and Verbindlichkeit. The nature of the presupposition in question here has been a subject of controversy ever since. Presupposing the basic norm gives rise to formulations that are neither purely descriptive nor purely normative. The author contends that Kelsen's doctrine of the basic norm was intended to apply to all jurists irrespective of function. Who presupposes Kelsen's basic norm? Is it possible to defend the presupposition in a way that is convincing? And what difference does the presupposition make? Endeavouring to highlight the role of basic assumptions in the law, the author argues that the verb "to presuppose', with Kelsen, has not only a conceptual but also a normative dimension; and that the expression 'presupposing the basic norm'is adequate in so far as it marks the descriptive-normative nature of utterances made in specifically legal speech-situations.Addressed (...) to legal theorists in general, the treatise purports to show that Kelsen's doctrine lends itself to an interpretation according to which the very act of "presupposing" the Grundnorm can be understood as a Grund, i.e. normative source of all positive law; and, what is more, that this interpretation admits of addressing the issue of the (formal) legitimacy of supra-national and directly applicable rules and other norms. Adducing a well-known Swedish debate where the meaning of this term is manifestly coloured by the speakers’ participation in particular discourses, the author argues that the term is ultimately a discursive construct, unsuited to the needs of legal theoreticians in quest of clarity.

Dabei sollen im Rückgriff auf Konzeptionen zur narrativen Identität mittels einer möglichst genauen Beschreibung und Analyse der Selbstwahrnehmung der Patienten sowie der Wahrnehmung ihres Umfelds die Änderungen im praktischen Selbstverhältnis untersucht werden, u. a. am Beispiel technomorpher Metaphern, die von den Patienten in ihren Selbstbeschreibungen verwendet werden. Ziel ist es, die Neuartigkeit und das Spezifische der Neurotechnologien – über die bisherigen (...) Untersuchungen hinaus – hinsichtlich des Umgangs mit sich selbst herauszuarbeiten und greifbar zu machen. A currently popular view traces autistic cognitive abnormalities to a defective capacity for theorizing about other minds. Two prominent researchers, Uta Frith and Francesca Happé, extend this account by tracing further autistic abnormalities to impaired self-consciousness. This paper argues that Frith and Happé's account requires a treatment of autistic self-report that is problematic on both methodological and philosophical grounds. However, the philosophical problems point to an alternative account of self-awareness and self-report in normal individuals; and this account gives us a (...) methodologically more attractive approach to explaining autistic abnormalities. This article argues that the causal loops that occur in some time-travel scenarios and in certain solutions of the theory of relativity are no more mysterious than the infinitely descending causal chains familiar from Newtonian mechanics.

This paper offers a critique of the Bayesian interpretation of quantum mechanics with particular focus on a paper by Caves, Fuchs, and Schack containing a critique of the “objective preparations view” or OPV. It also aims to carry the discussion beyond the hardened positions of Bayesians and proponents of the OPV. Several claims made by Caves et al. are rebutted, including the claim that different pure states may legitimately be assigned to the same system at the same time, and the (...) claim that the quantum nature of a preparation device cannot legitimately be ignored. Both Bayesians and proponents of the OPV regard the time dependence of a quantum state as the continuous dependence on time of an evolving state of some kind. This leads to a false dilemma: quantum states are either objective states of nature or subjective states of belief. In reality they are neither. The present paper views the aforesaid dependence as a dependence on the time of the measurement to whose possible outcomes the quantum state serves to assign probabilities. This makes it possible to recognize the full implications of the only testable feature of the theory, viz., the probabilities it assigns to measurement outcomes. Most important among these are the objective fuzziness of all relative positions and momenta and the consequent incomplete spatiotemporal differentiation of the physical world. The latter makes it possible to draw a clear distinction between the macroscopic and the microscopic. This in turn makes it possible to understand the special status of measurements in all standard formulations of the theory. Whereas Bayesians have written contemptuously about the “folly” of conjoining “objective” to “probability,” there are various reasons why quantum-mechanical probabilities can be considered objective, not least the fact that they are needed to quantify an objective fuzziness. But this cannot be appreciated without giving thought to the makeup of the world, which Bayesians refuse to do. Doing this on the basis of how quantum mechanics assigns probabilities, one finds that what constitutes the macroworld is a single Ultimate Reality, about which we know nothing, except that it manifests the macroworld or manifests itself as the macroworld. The so-called microworld is neither a world nor a part of any world but instead is instrumental in the manifestation of the macroworld. Quantum mechanics affords us a glimpse “behind” the manifested world, at stages in the process of manifestation, but it does not allow us to describe what lies “behind” the manifested world except in terms of the finished product—the manifested world, for without the manifested world there is nothing in whose terms we could describe its manifestation. The choice to cooperate or compete with others confronts us on a daily basis, and it is plausible that we use our mentalising skills to aid decision-making in such situations. We investigated the relationship between mentalising and decision-making in the prisoner's dilemma in adults with autism spectrum disorders , who show impaired mentalising, and normal adults. After completion of three versions of the prisoner's dilemma, we conducted a semi-structured interview. This interview attempted to elicit a participant's spontaneous strategy when playing (...) each version of the game, as well as on their conception of the nature and strategy choice of their opponents . Contrary to expectations, the behavioural choices of the adults with and without ASD were quantitatively similar, as were the qualitative responses to questions used in the interview. The consistency of the evidence from both measures suggests that mentalising ability was not involved in selecting the choices made in these prisoner's dilemma tasks. Instead they suggest the hypothesis that a purely logical strategy may have been adopted. The introspections of at least a subgroup of high-functioning individuals with ASD can on the whole be trusted and this use of mixed methods strengthens the validity of the conclusions drawn.
